Terms of Use

These Terms of Use (“Terms”) govern your use of the Euterpe Notes mobile application (“App”) and related website and backend services (together, the “Service”) operated via euterpenotes.com and our transcription servers.

By installing or using the App or Service, you agree to these Terms.

1. What the Service does

Euterpe Notes helps you turn short piano audio into estimated music files (MIDI, MusicXML, and optionally PDF). Transcription uses automated AI models on our servers.

2. Eligibility

You must be able to form a binding agreement under the laws of your country. The App is not directed at children under 13 (or the higher age required in your jurisdiction).

3. Acceptable use

You agree to use the Service only for lawful purposes. You must not:

• Abuse, overload, or attempt to disrupt the API or servers (including bypassing rate limits or API keys).
• Upload content you do not have the right to process, or content that is illegal or harmful.
• Use the Service for non-music bulk processing, spam, or automated scraping beyond normal App use.
• Reverse engineer the Service except where mandatory law allows.

We may refuse, rate-limit, or block requests that threaten stability or fair use (including concurrent job limits and per-IP limits).

4. AI output disclaimer (important)

Transcription is an estimate. Results may contain wrong, missing, or extra notes. Melody mode is generally more reliable than chords or pedal. Grand staff layout is a pitch split, not true hand separation. Do not treat output as a professional engraving or as proof of what was performed. Always verify against the original performance before public use, teaching, exams, or publication.

5. Your content

You retain rights in audio you record or upload. You grant us a limited license to process that audio solely to provide transcription and file conversion, and to operate and protect the Service (security, abuse prevention, short-term logs), as described in our Privacy Policy.

Server-side job files are temporary. We do not claim ownership of your music.

6. Intellectual property

The App name, branding, website design, and software (excluding your content and open-source components used under their licenses) are protected by applicable law. You may not copy or redistribute the App or branding except as allowed by the store or license under which you obtained the App.

7. Third-party services

Distribution via Google Play is subject to Google’s terms. Device OS permissions and file handlers (e.g. opening MIDI in another app) are outside our control.

8. Availability and changes

The Service is provided “as is” and “as available.” We may change, suspend, or discontinue features, limits (duration, rate limits), or the Service as a whole. CPU processing times vary; busy periods may return errors.

9. No warranties

To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy of transcription, and non-infringement. The Service may have bugs or downtime.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill arising from use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) €50, except where liability cannot be limited by law (e.g. death or personal injury caused by negligence, or fraud).

11. Privacy

Personal data processing is described in the Privacy Policy, which forms part of these Terms by reference.

12. Termination

You may stop using the App at any time (uninstall). We may suspend access if you violate these Terms or if needed to protect the Service or other users.

13. Governing law

Unless mandatory consumer protection rules in your country say otherwise, these Terms are governed by the laws of the country where the Service operator is established, without regard to conflict-of-law rules. Courts in that country have non-exclusive jurisdiction; consumers may also bring claims in their home courts where required by law.
